Voters seek Supreme Court's direction on validity of rejected votes



Registered voters have moved to court to the supreme court seeking interpretation on whether the rejected votes cast should be used in the final determination of a presidential election at the supreme court. They want the court to determine whether the independent electoral and boundaries commission was right to include the rejected votes on the tallying of the presidential votes in the just concluded election. 

The three, Dennis Itumbi, Moses Kuria and Florence Sergon are questioning if the presidential election tallying center had any authority in law to alter the constitution basis of counting votes to vary the percentage of votes. They also want the court to rule that IEBC erred by including the rejected vote claiming under rule 77 of election regulation 2012 says that a rejected vote is not a vote capable of being favored in the tallying process.

The voters claim if the supreme court decision favors them, then the percentages obtained by president-elect Uhuru Kenyatta and cord candidate Raila Odinga would increase slightly
