WAITITU CHALLENGES KIDERO'S ELECTION


The High court has directed an election petition lodged by former Embakasi MP Ferdidand Waititu be heard tomorrow morning after serving the Independent Electoral Boundaries Commission (IEBC). Waititu moved to court under a certificate of urgency to challenge the election of Dr Evans Kidero as governor elect of Nairobi.

Waititu wants the court to stop the gazettement by the IEBC of Kidero until his petition is heard and determined. Presenting his case before Lady Justice Mumbi Ngugi, Waititu wants IEBC compelled to give records of polling stations of Westlands, Ruaraka, Langata, Kibra, Embakasi and Mathare constituencies where he claims that illegal votes were cast from non-existent votes. 

Nairobi County declared invalid saying the results were announced before final tallying. Waititu through lawyer Harrison Kinyanjui claims the form 36 that declared the official results was never signed by the County returning officer and only had an IEBC rubber stamp. Dr. Kidero clinched the seat after polling 692, 483 votes against Ferdinand Waititu of TNA who polled 617, 839 votes. Jimnah Mbaru of APK came third with 52,084 votes.
